SERVICE AGREEMENT
DUBAITATILI.COM & FLY WING TOURISM PACKAGED TOUR AGREEMENT GENERAL TERMS AND CONDITIONS
In accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Packaged Tour Contracts dated 14.01.2015, prior information has been provided to the consumer, a brochure was given before the contract was established, and this agreement is prepared under the following terms.
For the products and services for which we provide brokerage services, the contracts of the tour operator shall be valid.
1-) PARTIES AND SUBJECT MATTER
On one side TAJ ISTANBUL TOURISM AND CORPORATE CONSULTANCY LTD. STI. Address: Ümmühan Neighborhood, Dibek Street, Building No:23/1 Ayvacık, Çanakkale
(Hereinafter referred to as "Agency"). On the other side, this packaged tour contract has been concluded between the Agency and consumers regarding domestic and international tours.

In this agreement, the CONSUMER declares that they are acting on behalf of the participants and representing and binding them. They are obligated and responsible for informing the participant about the pre-information provided to them within the scope of relevant legislation and the content of the brochure. The consumer who fails to fulfill their obligation to inform shall be liable for it. In this regard, the brochure given to the consumer shall be considered as having been given to the participant.
The CONSUMER is responsible for providing accurate information about themselves and other participating individuals and for having this information recorded in the contract. The AGENCY is not responsible for any consequences (e.g., airline fines, visa issues, etc.) arising from incorrect reporting of identity and contact information.
The parties accept the addresses indicated as their legal notification addresses. The parties agree to notify each other in writing of any changes to these addresses; otherwise, notifications sent to these addresses shall be deemed valid.
2-) CONTRACT PRICE
The contract price is as specified in the Voucher (Reservation Certificate).
2.1 This price includes all services specified in the tour or hotel reservation certificate (VOUCHER). Hotel check-in/check-out dates, durations, transportation details, and board status are as specified in the Voucher/Tour Registration Certificate. Tours and services outside of these are subject to additional charges. Taxes, duties, fees, and similar public payments required by the legislation of the countries to be visited, as well as price changes resulting from exchange rates, shall be passed on to the consumer. This situation will be immediately reported to the consumer. After such notification, the consumer may withdraw from the contract, in which case cancellation conditions apply, or they may accept the modifications and the impact on the price as specified in the supplementary agreement.
3-) PAYMENTS
3.1 At the time of registration, at least 10% of the reservation fee must be paid, and the remaining balance must be paid no later than 30 days before the start of the tour. If the specified payments are not made within the mentioned periods, the reservation will be cancelled, and 30% of the fee will be charged to the consumer as a cancellation penalty.
3.2 A consumer purchasing a Special Product/Promotional service is obligated to pay the full amount of the service fee on the reservation date.
3.3 For special products and Early Reservation discounted services, the balance must be paid no later than 60 days before the start of the service. In credit card payments, interest, maturity difference, and currency difference will be calculated separately, and the payment plan will be communicated to the consumer.
4-) CANCELLATION, TRANSFER, AND MODIFICATIONS
4.1 Despite exercising all necessary care, the Agency may cancel or postpone the tour due to circumstances preventing the start or continuation of the tour, including but not limited to failure to reach the required number of confirmed passengers, adverse weather conditions, road blockages, strikes, terrorism, fog, war risks, unforeseeable technical issues, and all force majeure events. In such cases, the consumer has no right to compensation.
4.2 When the consumer requests to cancel the tour up to 30 days before the start of the service, the amount paid minus 10% will be refunded to them without deduction. (Excluding mandatory insurance, travel health-visa insurance, visa application fees, and reservations made for Promotional Special Package Tours.)
4.3 In case of cancellation 30-21 days before the start of the tour, 35% of the tour fee; cancellations made 20-10 days before the start, 50%; and cancellations made after 10 days, the entire tour fee will be charged to the consumer as a cancellation penalty. If the consumer presents official committee reports from a fully equipped state hospital demonstrating illnesses or deaths of themselves or first-degree relatives that prevent their usual activities for 10 days prior to the start of the service, the remaining amount after deducting non-refundable payments made for the package tour (such as flights, hotels) will be refunded.
4.4 The consumer may transfer the tour to another person up to exactly 7 days before the start of the service. The transferee is jointly responsible with the transferor for the outstanding balance and all expenses arising from the transfer. The consumer is obligated to submit all Cancellation/Transfer requests in writing to the Agency before the start of the service. The AGENCY cannot be held liable if the visa service is not completed in time.
4.5 If the consumer does not inform the Agency in writing that they will participate in the service whose start they have missed; the Agency has the right to cancel all reservations and services made on behalf of the consumer after 24 hours. In such cancellations, no refund of any fees will be made to the consumer.
4.6 The Agency may partially or completely cancel tours announced or registered, subject to notifying the Consumer when deemed necessary, before the start of the service. During the same period or during the service, the Agency may change the names of hotels within the scope of service, vehicles used for transportation and their departure points, and the order of visits to places shown as destinations in the program. If the consumer does not accept these changes and cancellations for valid reasons, they have the right to cancel their reservation and claim a refund for unused service fees. In this case, cancellation conditions apply.
4.7 The Agency may replace the hotel included in the Package Tour with another hotel of similar status when necessary.
4.8 In scheduled flights, penalties and deductions applied by the airline according to ticket rules for cancellations made 15 days or earlier will be passed on to the consumer exactly as is. For scheduled and Charter flights, cancellations made 15 days or later will not be accepted for any reason, and no refund of the flight fee will be granted.
4.9 According to Law No. 1618, the mandatory travel insurance and health insurance fee is 15€ (equivalent in TL). The mandatory travel insurance fee is 15 TL for domestic services. In all cancellations and/or changes made by the consumer, regardless of whether they occur more than 30 days before the start of the service or involve date changes, this fee will be collected from each consumer.
5 -) DURATION OF THE TOUR, MEALS AND DRINKS
As specified in the Voucher & Tour Brochure (person, accommodation, and tour details).
6 -) DEPARTURE TIMES
The departure times of transportation vehicles such as airplanes, ferries, trains, buses, etc., are the times valid on the date the contract was concluded. The Agency is not responsible for fare changes made later by carrier companies. The departure locations, times, and number of departures of transportation vehicles such as airplanes, ferries, trains, buses, etc., specified in the contract should be checked with the Agency before the tour. Changes may be made due to various reasons related to transportation vehicles or unrelated reasons. The Agency is not responsible for delayed arrivals caused by airlines. While our Agency informs passengers of tour movement details, passengers are also obligated to learn these details. The departure times for this tour are as specified in the voucher (accommodation and tour details) document. STOPPING POINTS: Rest stops will be made at rest facilities along the route. Details such as the frequency of stops at rest facilities are at the discretion of our guides and captains/drivers. Stopover locations may vary depending on air, road, and general conditions.
7 -) LUGGAGE
7.1 Each consumer participating in the tour has the right to carry and bring two suitcases not exceeding dimensions of 50cm x 70cm in any tour, and in air travel, luggage weighing up to 20kg. Money, valuable documents, and similar precious jewelry should not be kept inside the luggage.
The Agency cannot be held responsible for lost, damaged, or missing luggage and valuable items contained therein.
7.2 Items with odors, leaking, flammable, explosive properties, or those causing disturbance to the surroundings, cutting/piercing weapons, firearms, and all kinds of animals will not be taken into transport vehicles or accommodation facilities without the explicit written permission of the Agency.
7.3 The Agency is liable for any loss, damage, or theft of goods declared in writing with their values and handed over to them, up to the amount of the tour's transportation fee.
8 -) VISA PROCEDURES
Visa and Passport procedures belong to the consumer. However, if all necessary documents are submitted to the Agency in complete form at least 30 days before the start of the tour (Only applicable for Dubai Visa applications. For visa applications to other countries, at least 60 days before the tour departure date is required. Requirements may vary according to the visa application conditions of the countries.), visa consultancy services can be provided for a fee. The submitted passport must be valid for at least 6 months from the tour end date. For Package Tour operations, a visa kit must be shared by the operator to enable visa application. Based on your Package Tour reservation, a request for a visa kit will be made by us to the operators (Only applicable for Package Tours purchased through Dubaitatili.com), and subsequently, the visa application will take place. Dubai visa applications can be processed up to 7 days before the tour date. Since visa procedures are entirely at the discretion of the consulates, the Agency has no authority to impose sanctions on the consulate or guarantee performance obligations, nor does it bear responsibility for its brokerage role. The Agency is not responsible for delays or disruptions at consulates. If the tour is cancelled for any reason, the balance excluding visa fees, expenses, and service costs will be refunded to the customer. Even if the inability to obtain a visa falls within the cancellation, transfer, and modification periods, the consumer accepts the penalty clauses and all financial obligations arising from them. Consumers who do not accept these conditions may follow up on their visa procedures themselves. Furthermore, since obtaining a visa does not guarantee entry into the country, no payments will be made in the destination country, and the Agency will not be liable for damages arising from this situation. Passports older than 10 years must be renewed by law; this is the consumer's own duty of care.
9 -) GUIDE FEE
The guide fee is included in the tour price for tours where a guide is specified.
10 -) GENERAL PROVISIONS
The scope of coverage for deficiencies, defects, damage, losses, and claims related to consumers who have obtained travel health visa insurance or are included in a travel insurance package is determined by the policy of the insurance company providing this service. The Agency bears no responsibility regarding the content, scope, or implementation methods of these coverages. The consumer is obligated to obtain the scope of travel insurance from the sales representative.
The Agency acts as an intermediary between the airline and the passenger and is subject to the Hague Protocol of 28.09.1955. Flight times may change prior to the flight, and all times must be confirmed 48 hours before the departure date. For international trips, a passport valid for at least 6 months is mandatory. If the number of participants joining the package tour is insufficient, the tour cancellation will be notified to the consumer 20 days in advance. Route changes may occur depending on the city where the plane lands.
